Waiver & Release of Liability
Please read this carefully. By agreeing to it, you are giving up certain legal rights.
1) Voluntary Participation & Health Acknowledgment
I am voluntarily participating in physical activity and exercise. I understand it is my responsibility to consult a physician before participating if I have any concerns, symptoms, or known conditions. I agree to inform the Trainer of any limitations, injuries, or conditions (including pregnancy) before participating, and I have answered the health question on the registration form truthfully.
2) Assumption of Risk (Strength & Movement)
I understand that group exercise, strength training, and dance-inspired movement involve inherent risks, including but not limited to:
- muscle strains, sprains, fractures, soreness, overexertion, and fainting
- injury from strength and resistance exercises, jumping, balance and direction changes, and falls
- slips or falls on floors or other surfaces, and contact with equipment, mats, or props
- overheating, dehydration, dizziness, and heat exhaustion
- contact with other participants in a shared space
- allergic reactions or other unknown risks
I knowingly and voluntarily assume all risks, known and unknown, associated with participating.
3) Waiver and Release of Liability
In consideration of being permitted to participate, I hereby waive, release, and forever discharge the Trainer, Nani Soul Fit, any assistants, volunteers, affiliates, and sponsors, and the venue (Event Center Miami) and its owners, operators, and staff, from any and all claims, demands, causes of action, damages, costs, or liabilities of any kind arising from or related to my participation, including claims based on ordinary negligence, to the fullest extent permitted by Florida law.
4) Indemnification
I agree to indemnify and hold harmless the released parties from any claims, liabilities, damages, or expenses (including reasonable attorneys’ fees) arising out of or related to my participation, including claims brought by or on behalf of me or my family members, to the fullest extent permitted by law.
5) Safety Rules & Conduct
I agree to:
- follow the Trainer’s instructions and use proper form
- stop immediately if I feel pain, dizziness, shortness of breath, or illness
- behave respectfully toward the Trainer and other participants and avoid unsafe conduct
- bring water as needed and take rest breaks as appropriate
The Trainer may refuse or stop my participation if it appears unsafe.
6) Medical Emergency Authorization
If I require medical attention, I authorize the Trainer to seek emergency care on my behalf and to contact the emergency contact I provided. I understand I am solely responsible for any medical costs incurred.
7) Age & Registration
I am at least 18 years old and am registering myself. Minors may attend only with the Trainer’s prior approval and a signed parent/guardian consent; please contact the Trainer before registering a minor.
8) Registration Fee, Changes & Personal Property
The registration fee is non-refundable. The Trainer may modify, relocate, reschedule, or cancel the session for safety or other circumstances. I am responsible for my own belongings, and the released parties are not responsible for lost, stolen, or damaged property.
9) Electronic Acceptance
By checking the agreement box on the registration form and submitting it, I agree that my electronic acceptance has the same effect as a handwritten signature. Photo and video use is covered separately by the Social Media Release.
10) Governing Law / Venue
This agreement is governed by the laws of the State of Florida. Any dispute shall be brought in a court of competent jurisdiction in Broward County, Florida, unless otherwise required by law.
11) Severability
If any portion of this agreement is found unenforceable, the remaining portions remain in full force and effect.
12) Acknowledgment of Understanding
I have read this waiver fully, understand its contents, and agree to it voluntarily. I understand that by agreeing, I am giving up certain legal rights.
